BEXCS, Inc. (hereinafter referred to as “the Company”) stipulates the following Privacy Policy (hereinafter referred to as “the Policy”) with regard to the handling of Personal Information related with the services (hereinafter referred to as “the Service”) provided on this Website.
Personal Information is considered as Personal Information pursuant to the Act on the Protection of Personal Information, and it refers to the information of living individuals by which a certain individual can be identified, such as name, date of birth, address, telephone number, contact information, and other descriptive information, as well as single units of corresponding information, such as data related with physical appearance, fingerprints, voiceprint, health insurance card, insured person’s number and other information, than can be used as information (information for personal identification) for identification of an individual.
When applying for user registration with the Company, Personal Information such as name, date of birth, address, telephone number, e-mail address, bank account number, credit card number, driver’s license number, and other information may be collected. In addition, transaction records including Personal Information of users exchanged between users and our partners, etc., and information related to payments may be collected by our partners (information providers, advertisers, advertisement distribution targets; hereinafter collectively referred to as “Partners”).
The Company collects and uses Personal Information for the following purposes.
To provide and administer the Service
To respond to inquiries from users (including personal identity verification)
To send guidelines by e-mail regarding new functions, updated information, campaigns, etc., related with the Service used by the user, as well as other services provided by the Company
To provide maintenance and important notification whenever necessary
To identify users who have violated the Terms of Use and users who intend to use the Service for fraudulent or unfair purposes, and prevent them from using the Service
In order for users to view, change, or delete their own registration information, and to view the usage status
To charge usage fee to the users for paid services
Any other purposes incidental to the above
The Company shall change the purpose of use of Personal Information only when it is reasonably acknowledged to have relevance with the purpose of use before its modification.
In the event of modification of the purpose of use, the users shall receive a notification regarding the modified purpose in accordance with the method set by the Company, and/or the modified purpose shall be announced on this Website.
Except for the following cases, the Personal Information shall not be disclosed or provided to third parties without prior consent of the user. However, this does not apply to cases included in the Act on the Protection of Personal Information, and other laws and regulations.
When required for protection of human life, body or property and difficult to obtain consent of the person in question
When a particular necessity exists in order to improve public health or promote healthy development of children, and is difficult to obtain consent of the person in question
When it is necessary to cooperate with an agency of the state or local government organization or their agent in the execution of duties stipulated by law, and obtaining consent of the individual would pose a risk to the execution of such duties
When the following is notified or publicized in advance, and when submitted to the Personal Information Protection Committee by the Company
When providing information to a third party is included in the purpose of use
Data category to be provided to a third party

Accepting the request of the person in question
Notwithstanding the provisions of the preceding paragraph, the recipient of information shall not correspond to a third party in the following cases.
When the Company is required to disclose or provide all or part of the handled Personal Information within the scope necessary for the purpose of use
When Personal Information is provided at the succession of business due to a merger or other reasons
When Personal Information is shared with a specific individual, the person in question shall be notified in advance about the intention and items of Personal Information to be shared, as well as the scope and the purpose of use of the used shared information, including the name and title of the person responsible for the management of correspondent Personal Information, or the conditions for the person in question to have easy access to such shall be put in place
When the person in question requests the Company to disclose their Personal Information, the Company shall abide in a swift manner. However, if disclosure corresponds to any of the following, all or part may not be disclosed, and in such case, the Company shall provide a notification in a swift manner. When disclosing Personal Information, a fee of 1,000 JPY shall be charged per case.
When in risk of harm to human life, body, property or other rights and interests of the person in question or a third party
When in risk of significant damage to proper implementation of the Company business
When in violation of other laws and regulations
Notwithstanding the provisions of the preceding paragraph, information other than Personal Information such as historical and characteristic information shall not be disclosed as a principle.
When Personal Information kept by the Company is incorrect, the user may request the Company to modify, add or delete (hereinafter referred to as “Modification”) their Personal Information pursuant to the procedure stipulated by the Company.
When the Company deems the user’s request from the preceding paragraph requires compliance, the Company shall implement Modification of corresponding Personal Information in a swift manner.
When Modification deriving from the preceding paragraph is implemented, or when it is determined to not be implemented, the Company shall notify the user in a swift manner.
The Company shall suspend use or eliminate Personal Information (hereinafter referred to as “Suspension of Use”) for reasons of the information being handled beyond the scope of purpose of use or because the information was acquired by fraudulent means. In such case, the Company shall conduct the required investigation in a swift manner.
When deemed necessary to comply to the request deriving from the investigation results from the preceding paragraph, the use of corresponding Personal Information shall be suspended in a swift manner.
When Suspension of Use deriving from the preceding paragraph is implemented, or when it is determined to not be implemented, the Company shall notify the user in a swift manner.
Notwithstanding the preceding two paragraphs, when Suspension of Use is costly, and difficult to implement, if it is possible to take alternative measures necessary to protect the benefit and rights of the user, this alternative measure shall be considered.
Excluding matters stipulated by laws and regulations as well as other stipulations of the Policy, the content of the Policy my be modified without notifying the users.
Except for cases otherwise stipulated by the Company, the modified Privacy Policy shall take effect upon publication on this Website.
